TERMS AND CONDITIONS OF SALE
1.
PAYMENT: All
goods sold by Rivers animal housing (the seller) shall remain the
property of the seller until fully paid by the purchaser (the
buyer), notwithstanding that the risks and the goods passed to the
purchaser when delivered and notwithstanding that the buyer may not
have possession of the goods.
2.
DELIVERY: Charges
for delivered products vary according to quantity, product and
location. Deliveries
will normally be during daylight hours, unless prior arrangement has
been made between the two parties.
Most deliveries are made by the seller’s own transportation
and staff but the seller reserves the right to use third parties as
necessary. A signature
may be required upon delivery.
Goods are available for collection from our factory from 8 am
to 4 pm Monday to Friday or by prior arrangement outside of these
times. If the buyer’s
goods were not ready for delivery or collection after eight weeks
from ordering the buyer shall be entitled to cancel their order and
receive a full refund for standard manufactured products.
3.
ACCEPTANCE OF THE GOODS:
The buyer shall be deemed to have accepted the goods after
delivery to the buyer. The
buyer should carry out an inspection of the goods upon receipt of
delivery and should telephone the seller within 24 hours of the
delivery time, followed by written confirmation to the seller within
five working days of delivery of the goods, of any defects which a
reasonable examination would have revealed.
Where the buyer has accepted or has been deemed to have
accepted the goods, the buyer shall not be entitled to reject goods
which are not in accordance with the contract. Risk shall pass on delivery of the goods to the buyer’s
address. This should
specifically occur if the buyer has asked the seller to leave the
goods in particular place whilst not in attendance.
4.
FORCE MAJEURE:
The seller shall have no liability to you for any failure or
delay in supply or delivery or for any damage or defect to goods
supplied or delivered hereunder that is caused by any event or
circumstance beyond our reasonable control (including without
limitation strikes, lockouts and other industrial disputes).
No claim whatsoever for the buyer’s loss of time, materials
or livestock costs
shall be entertained by the seller.
5.
PRICING: All
prices are valid at the date of publishing but the seller reserves
the right to alter prices from time to time.
6.
WARRANTY: If
the buyer is not fully satisfied with the product on the grounds of
material quality or standard of workmanship and has complied with
point 3 of these terms and conditions, the seller shall, at their
discretion, either repair, replace or refund part or all of monies
paid to make good any defects within a reasonable timescale.
For standard items purchased but not required by the buyer
these must be returned to the seller at the buyer’s own cost,
unused, undamaged, complete and ready for resale, and shall be
subject to a 25% handling charge plus any delivery charges.
There is no return facility for products made to special
order.
7.
GENERAL: All
items are offered for sale subject to availability.
All descriptions are given in good faith and are as accurate
as possible. Please
note that the seller cannot give an unqualified guarantee on timber
based products as timber is a natural product and is liable to
shrinkage, cracking and warping.
Owing to a policy of continuous updating and improvement
there may be slight changes in the specification of goods supplied.
Rivers animal housing reserves the right to alter the
material, contents or design of any goods without prior notice.
All sizes of timber are nominal and overall measurements
approximate. If any
part of these conditions are invalid, illegal or unenforceable
(including any provision in which the seller excludes their
liability to the buyer) the validity, legality or enforceability of
any other part of these conditions will not be affected. This contract shall be governed by and interpreted in
accordance with English law.
8.
CONTRACT: The
seller’s acceptance of the buyer’s order for supply of goods
constitutes a legally binding contract between the buyer and the
seller on the above terms and conditions. |
